New dedicated unit to focus on coronavirus claims

COVID-19 changes everything. It threatens individual lives, imperils the stability of the economy and has the most dramatic effect on commercial activity in generations.

At Thompson and Bryan we have set up a dedicated unit to understand how we can best serve our broker friends and their policyholder clients.

We have researched policy covers – and they are myriad – looked at the legislation on notifiable diseases, taken note of case law and developed good practice for the assessment and handling of claims for COVID-19-related losses.

This hasn’t been easy, for a number of reasons. First, the wide variety of policy wordings, everything from “You must be joking” to “Yes, but”. Then the precise dating of the trigger event under the cover. Anticipating stratagems that insurers will advance and that will need to be challenged.

We have discovered elements where we believe that the Financial Ombudsman would be favourably inclined, but a court less so, and the hard fact is that few of our commercial clients are FOS-eligible, though the new eligibility criteria will help some businesses. We’ve even looked at corporate travel policies.

We understand the uncertainties of the insuring industry and its public, and we want to help. We’ve set up a separate email for broker enquiries, and will give a brief preliminary opinion.
