Storm Damage & Resultant Insurance Claim Dispute

Following major storms occurring in Central and West London, we were appointed to assist a Policyholder in relation to claims arising from flooding to the basement of the extensive property.

What We Did

At the time of our appointment, the client’s Insurer declined to meet the claim and issued a Reservation of Rights, in relation to alleged nondisclosures and potential fraud. Our Technical Team investigated the issues of concern to Insurers and worked with the client and building contractors to provide robust evidence of compliance with policy terms and conditions and veracity of the claimed reinstatement costs.   Our investigations into the historical underwriting of the risk over more than 20 years by the Insurer, demonstrated that their position had not been prejudicially affected by factors cited as material in their refusal to meet the policyholders’ claim.   

The Outcome

Insurers considered our representations and supporting evidence following which, they withdrew the Reservation of Rights and accepted policy liability for the claimed losses. Our Surveyor led subsequent negotiations regarding the extent of damage and resultant remedial works/costs. Following which, an all inclusive early settlement exceeding £2.5m was secured for the client.
