River Kent bursts its banks in Kendal

Liability – this wasn’t an issue as the cause was River Kent bursting its banks in Kendal. The flood occurred in December 2015 and we had to manage the expectations of not only the charity that ran the almshouse, but also the 15 tenants that occupied the building.
All the tenants were relocated to temporary premises and the work was split into 3 phases – strip out, drying and repairs. However, following the strip out work, major structural problems with the building were found and additional repairs were required that were not covered under the policy.
We therefore agreed an indemnity payment with insurers which comprised a cash sum towards the main repairs and advance payment of alternative accommodation costs and loss of rent, to the end of the notional reinstatement period. We further agreed that once reinstatement takes place and expenditure proved, additional payments would be made to the charity.
